1. Acceptance of Terms
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract.
2. What Cabinator Does
Cabinator is an operational intelligence platform for vacation rental owners. The Service analyzes information about your properties, market conditions, and local events, and generates briefings, scores, alerts, and recommendations — including pricing suggestions — intended to help you operate your rental business ("Recommendations").
3. Recommendations Are Informational — No Guaranteed Results
This section is central to your use of the Service. Read it carefully.
(a) You decide, not Cabinator. All Recommendations, including pricing suggestions, confidence ratings, event impact estimates, and Property Health scores, are informational tools only. You are solely responsible for every business decision you make, including whether to accept, modify, or reject any Recommendation.
(b) No guarantee of outcomes. We do not guarantee, promise, or warrant any particular result from using the Service, including increased revenue, occupancy, bookings, rankings, or business performance of any kind. Rental outcomes depend on factors outside our control, including market conditions, competition, property condition, guest behavior, weather, and events.
(c) AI-generated content may be wrong. Recommendations are generated in whole or in part by artificial intelligence and statistical models. They may be inaccurate, incomplete, outdated, or unsuitable for your situation, even when presented with a "High" confidence rating.
(d) No liability for outcomes. To the maximum extent permitted by law, neither Cabinator nor its owners, members, employees, or agents shall be liable for any loss, damage, lost revenue, lost bookings, or other outcome arising from your use of, or reliance on, the Service or any Recommendation.
4. Not Professional Advice
The Service does not provide legal, financial, tax, real estate, or investment advice. Recommendations are not a substitute for advice from qualified professionals. Consult your own advisors before making significant business decisions.
5. Third-Party Data and Services
The Service incorporates data from third-party sources (event listings, market data, published schedules, and similar). We do not control and cannot verify all third-party data, which may be inaccurate or change without notice (for example, an event may be cancelled or rescheduled). The Service may also interoperate with third-party platforms you connect; your use of those platforms is governed by their own terms.
6. Your Account and Your Data
(a) You are responsible for your account credentials and all activity under your account, and for the accuracy of the information you provide about your properties.
(b) You retain ownership of the data you submit. You grant us a license to use, store, and process it to provide and improve the Service.
(c) Aggregated and anonymized data. You agree that we may aggregate and anonymize data derived from your use of the Service and combine it with data from other users to identify market trends and improve Recommendations for all users. Anonymized aggregate data will not identify you or your specific properties. You may opt out of contributing to aggregated insights in your account settings; opting out may reduce the market intelligence available to you. Our collection and use of personal information is described in our Privacy Policy.
7. Subscriptions, Billing, and Refunds
(a) Paid features are billed as a subscription through our payment processor (Stripe). Prices are shown at purchase and may change with notice effective at your next renewal.
(b) Subscriptions renew automatically until cancelled. You may cancel at any time in your account settings; cancellation takes effect at the end of the current billing period.
(c) Except where required by law, payments are non-refundable, including for partial billing periods.
(d) We may suspend or downgrade accounts with failed payments after reasonable notice.
8. Acceptable Use
You agree not to: misuse, reverse-engineer, scrape, or resell the Service; use it to violate any law or third-party right; attempt to access other users' data; interfere with the Service's operation; or use automated systems to extract Recommendations at scale. We may suspend or terminate accounts that violate this section.
9. Intellectual Property
The Service, including its software, models, design, and content (excluding your data), is owned by PCBC LLC and protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for managing your own rental properties.
10. Service Availability and Changes
We may modify, add, or remove features at any time, and we do not guarantee uninterrupted or error-free operation. We may discontinue the Service with reasonable notice, in which case any prepaid, unused subscription fees will be refunded pro rata.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RECOMMENDATIONS WILL BE ACCURATE OR THAT USE OF THE SERVICE WILL PRODUCE ANY PARTICULAR BUSINESS RESULT.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) NEITHER PCBC LLC NOR ITS MEMBERS, OFFICERS, EMPLOYEES, OR AGENTS SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, LOST REVENUE, OR LOST BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE; AND (b) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Indemnification
You agree to indemnify and hold harmless PCBC LLC and its members, officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right in operating your rental business.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms or nonpayment. Sections 3, 4, 6(c), 9, and 11–16 survive termination.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes (by email or in-app notice) at least 30 days before they take effect.
(a) Continued use. Your continued use of the Service after the effective date of updated Terms constitutes acceptance of the changes.
(b) Renewal as acceptance. For paid subscribers, material changes will take effect no earlier than your next subscription renewal following notice. Renewal of your subscription after such notice constitutes acceptance of the updated Terms. If you do not agree to the changes, your sole remedy is to cancel your subscription before the renewal takes effect.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law rules. Disputes shall be resolved in the state or federal courts of the county of PCBC LLC's principal place of business in Mississippi, and you consent to their jurisdiction.
